Terms of Service

These Terms of Service ("Terms") govern your use of the GameGiftCard website and services operated by GameGiftCard Ltd, a company registered in England and Wales.

1. Definitions

In these Terms:

• "Digital Content" means game keys, activation codes, gift cards, and subscription codes sold through our platform
• "Consumer" means an individual acting for purposes outside their trade, business, craft or profession
• "Platform" means the gaming platforms (Steam, PlayStation, Xbox, etc.) where Digital Content is redeemed

2. Acceptance of Terms

By accessing or using GameGiftCard, you confirm that you are at least 18 years of age and agree to be bound by these Terms, including our strict no-refund policy for digital content.

3. Nature of Digital Content

GameGiftCard acts as a retailer of digital activation keys and codes. When you purchase Digital Content:

• You receive a license to use the product, not ownership of the underlying intellectual property
• The Digital Content is subject to the terms of the respective Platform provider
• Some Digital Content may be region-restricted; region information is displayed on the product page
• Age-restricted content requires you to confirm you meet the age requirements
• The purchase is final and non-refundable once the key is delivered to your account

4. NO REFUND POLICY

Due to the nature of digital products:

• Once a digital key is delivered to your account, the transaction is complete and irreversible
• No refunds are available for change of mind, wrong platform selection, or wrong region selection
• No refunds are available if you already own the product or your system doesn't meet requirements
• No price adjustments or refunds if the price changes after your purchase
• By completing a purchase, you expressly consent to immediate delivery and waive your 14-day cancellation right under the Consumer Contracts Regulations 2013

The only exception: If a key is invalid or already redeemed at the time of purchase (not due to your actions), we will provide a replacement key. Cash refunds are never provided.

5. Contract Formation

A legally binding contract is formed when:

1. You place an order and complete payment
2. We send confirmation that your order has been accepted
3. The Digital Content is delivered to your account

By clicking "Buy Now", you acknowledge that you have read and agree to our no-refund policy and consent to immediate delivery of Digital Content.

6. Pricing and Payment

• All prices are in USD (US Dollars) and include applicable taxes where required
• Payment is processed securely through NOWPayments
• We reserve the right to change prices at any time, but changes will not affect confirmed orders
• In case of a pricing error, we will contact you before processing the order

7. Delivery of Digital Content

• Digital Content is delivered instantly to your GameGiftCard account upon payment confirmation
• You will also receive an email confirmation with order details
• Delivery is considered complete when the key is available in your account, regardless of whether you have viewed it
• By purchasing, you acknowledge that delivery begins immediately and no cancellation is possible after delivery

8. Cancellation Rights - WAIVED

Under the Consumer Contracts Regulations 2013, consumers normally have a 14-day cooling-off period. However:

• By completing your purchase, you expressly request that delivery begins immediately and acknowledge that you will lose your right of withdrawal once the digital key is delivered
• Once the key is delivered to your account (whether viewed or not), the cooling-off period no longer applies
• This waiver is required at checkout before completing payment
• No exceptions are made for any reason, including change of mind or buyer's remorse

9. Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorised access
• Any purchases made through your account, even if unauthorised

10. Prohibited Activities

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorised access to our systems
• Purchase Digital Content for commercial resale without authorisation
• Use automated systems, bots, or scripts to access the service
• Engage in fraudulent activities or chargebacks
• Circumvent any regional restrictions on Digital Content

11. Chargebacks and Payment Disputes

Filing a chargeback or payment dispute for a legitimately delivered digital key is considered fraud.

• All delivered keys are logged with timestamps and IP addresses
• We will vigorously contest all fraudulent chargebacks and provide evidence to payment processors
• Fraudulent chargebacks will result in immediate account termination
• We reserve the right to pursue legal action and report fraud to relevant authorities
• Any associated keys will be reported to publishers for revocation

12. Intellectual Property

All content on GameGiftCard, including logos, text, graphics, and software, is owned by GameGiftCard Ltd or our licensors and is protected by UK and international intellectual property laws.

13. Limitation of Liability

To the extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages
• Our maximum liability for any claim is limited to the price paid for the specific Digital Content
• We are not liable for issues caused by Platform providers or your equipment
• Nothing in these Terms excludes our liability for death, personal injury, or fraud

14. Governing Law

These Terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Changes to Terms

We may update these Terms from time to time. Material changes will be notified by email or website notice. Continued use after changes constitutes acceptance.
